Description
Notaries are an integral part of the Curaçao legal system. A notary is a public official and makes agreements and statements legally valid by recording them in a notarial deed. A (junior) civil-law notary is an expert in the laws and regulations of real estate law, personal and family law and corporate law. A civil-law notary is an impartial expert who represents the interests of all parties involved when drawing up a notarial deed.
A notarial deed is the result of a complex process in which the notary advises his client(s) about the legal, tax and financial implications of the transaction and which legal means can best be used to achieve the client's goal(s). After a notarial deed is signed by a notary, the date of the deed is fixed vis-à-vis everyone and everyone can be confident that the deed has been signed by those listed as signers.
The notarial deed is primarily intended to provide great legal certainty and provides compelling evidence. In the law of evidence, the notarial deed therefore has a considerably stronger position than a non-notarial deed (a private deed).
